Recently, India operated 12 major ports and more than 200 smaller ports under the Government of India and a large port is a private port that works under private company (Kuntoji and Rao, 2015). In the current context, several international and domestic private investors are invited, in accordance with the BOT guidelines, to submit their competitive offer of port terminals on the basis of participation in turnover. To answer the second research question, it could be said that Indian bot projects operate according to the BOT guidelines, but there is still no defined legal framework. The BOT projects analysed above are largely nearing completion and few are available to the administration. Projects concerning the lack of transparency in contracting procedures, inadequate project instruction and the lack of clarity of the concession agreement should be improved in order to be fair and fair to all parties. Quality assurance and standard clauses should be improved to protect the interests of all parties. It could be said, however, that Indian government authorities need to pay more attention to renegotiation, risk measurement and the selection of projects that may be done in the future. Lessons must therefore be learned from the successful BOT projects in industrialized countries for the successful purchase of BOT in India`s public infrastructure sector.
